Excerpt from the Bill of Rights, Amendment I:
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press..."
Please observe that this does not contain any exceptions along the lines of "except when certain influential industry groups want to preserve their ability to plunder a public resource such as the RF spectrum for their own profit."
Article 19 of the Universal Declaration of Human Rights:
"Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers."
Please observe that this does not contain any exceptions along the lines of "except when the amount of spectrum allocated to public communication has been arbitrarily limited in order to keep individuals and small groups from using it."
